These Terms of Service ("Terms") govern your use of the photography, photo viewing, purchasing, and delivery services provided by Cashman Photo Enterprises of Nevada, Inc. ("Cashman Photo," "we," "us," or "our").
By viewing photographs, submitting an Access Code, making a purchase, or otherwise using a Cashman Photo guest service, you agree to these Terms and acknowledge our Privacy Policy.
Cashman Photo provides photography at venues, events, attractions, and other publicly accessible locations.
By participating in a photo interaction, or by remaining in an area where photography is conspicuously offered, you authorize Cashman Photo and those acting on its behalf to photograph you and to create, process, reproduce, display, offer, sell, deliver, store, and otherwise use the resulting photographs in connection with Cashman Photo's services, products, transactions, and business operations.
Photographs may be processed for storage and delivery. Processing may include compression, resizing, reformatting, watermarking, and the creation of previews and other derivative files. A delivered file may differ from the original capture.
Cashman Photo retains all rights available under applicable law, contract, venue terms, release, license, or other authority.
An "Access Code" is any code, order number, receipt reference, QR code, or link used to access photographs through a Cashman Photo service.
By submitting an Access Code, you represent that you are authorized to use it. Cashman Photo may rely on possession of a valid Access Code when providing access and is not required to verify the identity or authority of the person using it.
You are responsible for controlling who receives an Access Code provided to you. If you give an Access Code to another person, you authorize that person to view and purchase the photographs associated with it under these Terms.
You may not guess, generate, enumerate, harvest, publish, sell, or use an Access Code you are not authorized to use.
An Access Code applies only to the photographs currently associated with it. It creates no rights in any other code, photograph, transaction, or system.
Cashman Photo may limit, suspend, restore, or close access when reasonably necessary to operate or protect its services, photographs, transactions, or users.
A service may offer photographs or photograph sets for purchase. The product and price are presented before checkout. By submitting a purchase, you authorize Cashman Photo and its payment processor to process the transaction.
An order is accepted when the purchased files are made available to you. Before that point, Cashman Photo may decline or cancel an order and reverse the payment if:
By purchasing, you confirm that you reviewed the available preview and accept the photograph as shown. Except where the law requires otherwise, a digital sale is final when the transaction completes.
Cashman Photo does not provide refunds because of a change of mind, failure to download files while access was available, dissatisfaction with a photograph that was available for preview, loss of files after delivery, or use of an Access Code by someone the recipient shared it with.
Cashman Photo may, in its sole discretion, restore access, replace a file, correct a charge, or issue a refund when it determines a correction is appropriate. A discretionary correction does not create a right to future corrections.
Purchased photographs. When you lawfully purchase or receive a digital photograph, Cashman Photo grants you a limited, revocable, nonexclusive, nontransferable license to download and store it, print it for personal use, share it privately with family and friends, make ordinary personal edits, and post it to personal, noncommercial social media accounts, provided the post does not suggest an endorsement and is removed at Cashman Photo's reasonable request.
Previews. Watermarked previews are displayed only so you can review and select photographs for purchase. You may not copy, capture, download, or retain a preview, and preview availability may end at any time.
You may not:
No purchase transfers copyright or provides a model, property, venue, trademark, or other release. All rights not expressly granted are reserved.
You may not circumvent security or access controls, collect photographs or content by automated means, interfere with a service, access nonpublic systems, use a service or photograph for any unlawful purpose, or submit a false refund, ownership, removal, or privacy claim.
Cashman Photo may restrict, investigate, suspend, or terminate access when it reasonably believes a service, Access Code, photograph, or transaction is being misused.
Guest access is provided as a convenience for viewing, purchase, and delivery. Access may be limited, suspended, modified, or discontinued at any time for security, operational, legal, or business reasons.
You are responsible for downloading and keeping the photographs you want. Cashman Photo does not guarantee that any photograph, Access Code, or service will remain available for any period.
Access is provided for a limited time. To the fullest extent permitted by law, Cashman Photo is not liable for any inability to access photographs after the applicable access period has ended.
Closing or expiring an Access Code means only that the code no longer provides access through the applicable service. It does not mean the underlying photograph or related records have been deleted.
Contact us if you believe a photograph was taken without permission, photographs are associated with the wrong Access Code, an Access Code is being misused, or a photograph should not appear in a displayed set.
We may restrict access while reviewing a report and may require information reasonably necessary to identify the photographs, transaction, and requester. Any action we confirm applies only to the photographs, codes, and records identified. Closing an Access Code is separate from a request to delete an underlying photograph.
Our services use third-party providers, including payment, hosting, storage, and notification services, and may link to third-party sites. Third-party services are governed by their own terms and policies. Cashman Photo is not responsible for third-party services except as required by law.
To the fullest extent permitted by law, the services, photographs, and related content are provided "as is" and "as available," and Cashman Photo disclaims all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, title, and noninfringement.
Cashman Photo does not warrant that a service will be uninterrupted, secure, or error free; that every photograph will be available, complete, or correctly associated; or that a service will work on every device or network. Nothing in these Terms excludes a right that cannot lawfully be excluded.
To the fullest extent permitted by law, Cashman Photo and its owners, officers, employees, agents, affiliates, licensors, vendors, venues, clients, and operational partners (the "Protected Parties") are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from a service, photograph, Access Code, or transaction.
To the fullest extent permitted by law, the total liability of the Protected Parties for any claim will not exceed the amount you paid to Cashman Photo for the transaction giving rise to the claim. These limitations do not apply where prohibited by law.
You will indemnify and hold harmless the Protected Parties from claims, losses, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your misuse of a service, photograph, or Access Code, or a false claim you submit.
Informal resolution first. Before starting any formal proceeding, you agree to contact us, describe the issue, and give us sixty days to resolve it.
Time limit. To the fullest extent permitted by law, any claim must be brought within one year after it arises or it is permanently barred.
Governing law and venue. These Terms are governed by the laws of the State of Nevada, without regard to conflict of law principles. Any dispute relating to these Terms or a Cashman Photo service must be brought exclusively in the state or federal courts in Clark County, Nevada, and you consent to their jurisdiction.
We may update these Terms by posting the current version with its effective date. Terms applicable to a completed purchase will not be materially changed retroactively except where permitted or required by law. We may modify, suspend, or discontinue any service at any time.
We may assign these Terms. You may not assign them without our prior written consent.
These Terms are the entire agreement between you and Cashman Photo about the guest services and replace any earlier understandings. If any provision is held unenforceable, the remainder remains in effect. A failure to enforce a provision is not a waiver.
These Terms do not create rights in any third party, except that the Protected Parties may enforce Sections 11 and 12. Sections 5, 7, 10, 11, 12, and 13 survive termination of access or these Terms.
